General Terms and Conditions (GTC) of User Rights GmbH
 

1. Scope of application
These General Terms and Conditions (GTC) apply to all services provided by User Rights GmbH (“user-rights.org” or the “Dispute Resolution Center”). By using our services, you agree to these GTC.
 

2. Subject matter of the contract
User Rights GmbH offers a digital, transparent, simple and cost-effective procedure for dispute resolution between users of online platforms and the providers of these platforms in accordance with Article 21 (1) of the Digital Services Act (DSA).
 

3. Course of the procedure

  1. The request for dispute resolution should be submitted via the online form on our website. Alternatively, the form can be requested by email.
  2. The complainant must provide complete and truthful information. Obviously false information may lead to the application being rejected.
  3. The procedure is conducted by a randomly assigned arbitrator who is independent and impartial.
     

4. Costs
In principle, the costs of the conciliation procedure shall be borne by the respondent in accordance with the Dispute Resolution Service's cost regulations.
 

5. Confidentiality and data protection

  1. All parties involved are obliged to maintain confidentiality. Personal data will only be used within the scope of the proceedings and processed in accordance with the applicable data protection laws.
  2. The data protection provisions will be published on the Dispute Resolution Service's website and made available to the parties upon commencement of the proceedings.
     

6. Rights and obligations of the parties

  1. The parties have the right to be heard in the proceedings and to make statements.
  2. The outcome of the dispute resolution procedure is not binding.
     

7. Termination of the proceedings
The proceedings are terminated by withdrawal of the application, determination of inadmissibility, agreement in the proceedings or by decision of the dispute resolution provider.
 

8. Liability
User Rights GmbH shall only be liable for damages resulting from intentional or grossly negligent breaches of duty. Liability for simple negligence is excluded, unless it is a breach of essential contractual obligations.
 

9. Amendments to the GTC
User Rights GmbH reserves the right to amend these GTC at any time. Changes will be announced on the website. Continued use of the services after notification of the changes shall be deemed to constitute acceptance of the amended GTC.
 

10. Final provisions
The law of the Federal Republic of Germany shall apply.
