These Are Your Benefits
As a user, the situation is often difficult, as you stand little chance alone against the platforms—David versus Goliath. That’s why it’s good that the EU Commission has created a tool for citizens with the DSA, giving them the opportunity to assert their rights.
User Rights, as the first certified dispute resolution body, is your go-to resource for exercising your rights.
And these are your benefits:

    Legal Basis
User Rights was certified on August 12, 2024, by the Federal Network Agency under Article 21 of the Digital Services Act (DSA).
    What this means for you:
Our procedure has been legally reviewed and meets statutory requirements. As a user, individual, organization, or whistleblower, you can trust that your concern will be examined in a structured and legally grounded process thanks to this certification. The DSA was created to strengthen your rights in the digital space and to ensure that platform decisions are subject to independent oversight.
Our certification by the Federal Network Agency ensures that we operate under strict rules, report regularly, and make impartial decisions about the legality of measures. Platforms are legally obligated to collaborate with us and evaluate the implementation of our decisions.

    Legal Decisions
Our mission is to legally evaluate your case and provide a comprehensive decision. We assess whether actions, such as the removal of a post or failure to act on a report, were legally justified. This includes the application of both German and European law, taking into account freedom of expression and other fundamental rights.
    How we work:
Once you submit your case, our team of experienced legal professionals begins the review. We request statements and examine the information provided by both you and the platform.
After completing the review, you will receive a clear, detailed, and legally sound decision. This decision helps you plan your next steps, whether pursuing legal action or filing a complaint with the appropriate regulatory authority. While our decisions are not binding, they provide a thorough assessment of your rights and options. Platforms are required to review whether there are valid reasons against implementing our decision as part of their obligation to cooperate.

    Independent and Impartial
Our mediators work independently, impartially, and with the utmost care.
All of our decision-makers have a legal education and extensive expertise in German and European law. They make their decisions free from external influences and without connections to the online platforms, complainants, or other involved organizations.
Our evaluation of content moderation includes alleged violations of national law as well as breaches of the terms of service of the respective social media platform. We are certified for large parts of German criminal law, including (alleged) violations that threaten the democratic rule of law, crimes against public order, and various defamation offenses. Since terms of service violations are decided within a European legal framework, our certification regarding terms of service applies across Europe.
    Why this is important:
    • Impartiality: Our decisions are based solely on the legal and factual merits of the case.
    • Independence: We do not accept funding from platforms or other external parties.
    • Expertise: Our mediators are experienced legal professionals with a deep understanding of digital law and platform regulation.
We guarantee a fair and transparent process that prioritizes your rights.
